As of 12 November 2018, the Mexican Institute of Industrial Property (IMPI) will use the list of goods and services from the harmonised database (HDB) in TMclass and IMPI’s online tool ClasNiza.

En el presente año, la Ley de la Propiedad Industrial ha tenido cambios significativos en la protección de la creatividad, así como en diversos trámites, tarifas y definiciones de algunas figuras de protección.

[コメント] メキシコ政府の官報は5月18日に発行され、2018年8月10日から施行となります。今回の改正では、工業所有権法が改正され、外国の地理的表示のメキシコでの取り扱いを含めた法律として地理的表示(Geographical Indications)も導入されています。また、今回の商標法の改正では、商標の定義が拡張され、音、匂い、ホログラム、スローガンは登録可能となります。また、トレードドレスも獲得した識別性(acquired distinctiveness)を示すことで登録対象です。類見出しによる商品・役務の指定はできなくなり、ニース分類に従って個別の商品・役務を指定する必要があります。悪意ある商標は不登録とされ、著作権を有しない著作物を含む標章は登録できません。また、登録に際しての2次的意味の獲得(secondary meaning)も配慮されることとなり、競合時の同意書も有効となります。証明商標(certification mark)も登録可能となり、団体商標制度も拡大されています。
異議申立手続では、メキシコ知的財産庁(the Mexican Institute of Industrial Property (IMPI))は異議申立があった場合には出願を進めることなく、それぞれついて決定をする必要があります。
また、施行日以降に登録された全ての商標は登録３年目の応当日から延長できない３か月以内の期間で使用宣誓書(declaration of use)を提出する必要があり、更新時にも実際の使用について使用証明書を提出する必要があります。他の類の商品の使用では、証明できない規則になっています。もし使用証明を提出しない場合には、商標権は失効します。また、商標登録出願には、メキシコでの最初の使用日を申告する必要があります。
