LOUISVILLE, Ky. – Heaven Hill Distillery of Kentucky is taking Bob Dylan’s whiskey company to court, claiming trademark infringement involving its logo. Heaven’s Door Spirits is co-owned by the musician and debuted this year. WDRB-TV reports a Heaven Hill lawyer sent a cease-and-desist letter to Chicago-based Heaven’s Door in April, saying its “stacked” logo is similar to Heaven Hill’s. [コメント]　本家COACHに外観・称呼・観念のうちの１つの称呼が同じなので、商標が類似するとの考え方もありますが、「高知」の財布を本家COACHのものと混同して購入してしまう方も多分殆どいないと推測されるため、類似という判断にはならないところと思います。所謂パロディディフェンス(parody defense)が成立すべき件でしょう。特許庁的には、高知産の指定商品に限定して登録かもしれません。
