本件訴訟について2019年5月30日に知的財産高等裁判所で下された中間判決では、被告会社による「マリカー」、「maricar」等の表示の営業上の使用行為及び「マリオ」等のキャラクターのコスチュームを貸与する行為等が不正競争行為に該当することが認められました。今回の判決では、中間判決の判断を踏まえ、被告らに対して、5,000万円の損害賠償金（当該不正競争行為により被った損害の一部として、当社(任天堂株式会社)が本件訴訟で請求していた金額の全額）の支払いが命じられるとともに、被告会社に対して、これらの不正競争行為の差止等が命じられました。
知財高裁は昨年5月、「任天堂から使用の許可を受けていると誤信させる行為」と認めた一審・東京地裁判決を維持したうえで、新たに代表取締役について「悪意または重過失がある」との判断を先行して示していた。 この日の判決で知財高裁は「高い顧客吸引力を不当に利用しようとする意図があり、マリカー側の売り上げに貢献した度合いは相当に大きい」と指摘し、任天堂が請求した全額を賠償額として認めた。
