米国 商品・役務の記載

多区分にわたる同一アイテム

米国 商品・役務の記載(Identification)は、稀ですが、多区分にわたるような１つの商品を含むことがあります。機能、用途などで１つの商品の表示が多区分にわたるような場合、原則は、類の表記は商品の性質を定めることはないとされています。例えば、米国では”tool”は、電動では７類ですが、手動なら８類とされていますが、識別記載は７類か８類かたの区別をつけるための記載を必要とします。この原則には、例外があり、類の表記とともにその商品について理解できるものである場合には、補正を必要とはしません。 例えば、被服の”mufflers”については、補正を要せずに被服の類で表示すれば、自動車のマフラーとは理解されません。

米国 商品・役務の記載の包括的表現

米国 商品・役務の記載は明瞭で具体的である必要があり、包括を意味する”including,” “comprising,” “such as,” “and the like,” “and similar goods,” “products,” “concepts,” “like services” の様な表現はほぼ例外なく拒絶されます。一方、”namely,” “consisting of,” “particularly,” 及び “in particular” は明瞭であるとされています。また、”Parts therefor”は機械分野で受け入れられる表現であり、”dolls and accessories therefor” や “toy vehicles and accessories therefor” はそれぞれ人形と玩具で受け入れられた表現とされています。 これら示すところの商品が主たる商品と密接な関係にあり且つ同じ類であることが条件になります。

ハウスマーク(house mark)

ハウスマークの登録のための出願では、商品・役務の識別記載は”a house mark for….” の表現を含むことができます。ハウスマークは製造会社のすべての製品に使用されるような会社の標章を言います。もし外国優先権または外国登録のベースもしくは国際出願ベースの出願により、ハウスマークを登録しようとする場合には、審査官はハウスマークとして実際にマーク使用される証拠を要求できます。

一揃い

用語”a full line of”(一揃い)は、稀な場合に、USPTOが認める言葉であり、認められるためには、すべての商品が単一の区分に含まれることが必要となります。USPTOは “a full line of clothing”という用語を、全部の被服に亘って使用している証拠とともに認めることがありますが、単に”clothing”だけでは認められないとしています。商品の１つのジャンルの一揃い（例えば、”a full line of sports clothing” or “a full line of anti-viral and cardiovascular pharmaceuticals”）は、より適切とされ、そのような扱いとするためには、全ての商品が１つの区分に含まれ、全ての指定商品が使用されていることを証拠で示す必要があります。

コンピュータプログラム(Computer Program)

コンピュータプログラム分野では、不必要な他人の商標に対する拒絶を防ぐために、特殊性を記載することになっています。例えば、 “computer programs in the field of medicine” や “computer programs in the field of education” は、その分野の特殊な機能もしくは目的を示さない限り、原則認められないとされています。しかし、”computer programs for use in cancer diagnosis” や “computer programs for use in teaching children to read” は認められる例とされます。 意図する使用者、分野、産業(intended users, field, or industry )についての記載は、認められる記載に原則十分とは言えないとされていますが、 “computer programs in the field of geographical information systems”は認められる識別記載とされます。
原則としては、コンピュータソフトウエアの識別記載は、機能・目的、及びその分野の双方を記載することで認められるものとなります。以下は、米国 商品・役務の記載として認められる記載例と認めれらない記載例です。

認められる記載例

• (1) Computer game software.
• (2) Computer operating programs and computer operating systems.
• (3) Computer utility programs. ファイルを管理するプログラムや診断ソフトなど但しComputer utility programs, namely, business softwareはutility programではありません。”
• (4) Computer software development tools.
• (5) Database management software [if for general use, otherwise indicate specific field]; General purpose database management software; Computer software for use in database management; Database management software for use by financial advisors; Database management software in the field of baseball cards.
• (6) Spreadsheet software [if for general use, otherwise indicate specific field]:General purpose spreadsheet software; Computer software for use as a spreadsheet; Spreadsheet software for use by budget analysts.
• (7) Word processing programs [if for general use, otherwise indicate specific field]; Downloadable computer software for word processing; Computer programs for word processing.
• (8) Computer aided design (CAD) software [if for general use, otherwise indicate specific field]:Computer aided design (CAD) software for general use; Computer aided design (CAD) software used for designing integrated circuits; Computer aided design (CAD) software for architectural use.
• (9) Computer aided manufacturing (CAM) software [if for general use, otherwise indicate specific field]; Computer aided manufacturing (CAM) software for general use; Computer aided manufacturing (CAM) software used in the manufacture of airplane components; Computer aided manufacturing (CAM) software for integrated circuits.
• (10) CAD/CAM software [if for general use, otherwise indicate specific field]:

認められない記載例

• (1) Computer programs featuring multimedia (unless the applicant specifies the content, e.g., motion pictures in the field of [specify], recorded on computer media).
• (2) Computer firmware (unless the applicant specifies the function/purpose of the program, and, if the program is content or field specific, the field of use).
• (3) Computer devices (must specify the common commercial name therefor).
• (4) Computer accessories (must specify the common commercial name therefor).
