Taco Bell filed a petiton to cancel Taco Tuesday trademark
The taco chain filed a petition Tuesday (naturally) with the US Patent and Trademark office to cancel the trademark, owned by rival Taco John’s for 34 years, because Taco Bell claims the commonly used phrase “should be freely available to all who make, sell, eat and celebrate tacos.”
The United States Patent and Trademark Office (USPTO) is announcing the date, time, and place of a public hearing that will be held by the Trademark Public Advisory Committee (TPAC) on the USPTO’s proposed setting or adjusting of trademark fees pursuant to the USPTO’s fee setting authority under section 10 of the Leahy-Smith America Invents Act (AIA). The USPTO will make its proposed trademark fees available—as set forth in the SUPPLEMENTARY INFORMATION section of this notice—before the TPAC hearing. The public is invited to testify at the hearing and submit written comments regarding proposed trademark fees.
Canon and Amazon jointly sue account holders in US
TOKYO, May 11, 2023—Canon Inc. and Canon U.S.A., Inc. together with Amazon.com, Inc., and Amazon.com Services LLC jointly filed a lawsuit in the United States District Court for the Western District of Washington against 29 selling accounts which sold camera batteries and chargers in the Amazon store in the U.S., alleging infringement of Canon’s trademark rights.

Hermès has been handed a loss in the latest round of a bid to register its use of orange and brown on product packaging as a trademark in Japan. On the heels of the Japan Patent Office (“JPO”) refusing to register the mark on the basis that the color combination is not necessarily an indicator of source, the JPO’s Appeals Board rejected the Birkin bag-maker’s appeal, finding that Hermès selected its orange and brown-hued packaging “to enhance the impression and aesthetics of goods and services,” and that they are “not recognized to indicate the origin of goods or services and distinguish them from competitors.”
