A North Carolina business owner has filed a trademark infringement lawsuit in federal court against Baltimore-based athletic retail giant Under Armour. According to a complaint filed by Fayetteville businessman Kelsey Battle in the U.S. District Court for the Eastern District of North Carolina, Under Armour has continued to use his ICAN mark in one of its product lines since 2015.

Fashion brand Ralph Lauren has failed in its bid to invalidate an English polo club’s use of a logo depicting a horse-mounted polo player raising a mallet, after the Intellectual Property Office of Singapore (IPOS) threw out its arguments on all grounds on Friday (Dec 22).
In the complaint, the plaintiffs claim that they applied for two trademarks through LegalZoom and that the service they received constituted the practice of law. The complaint alleges that LegalZoom “trademark document specialists” who were not lawyers “provided legal advice to the plaintiffs by selecting classification and modifying the goods and services description from the template thereby applying specific law to facts.” The plaintiff recorded and transcribed those conversations with the LegalZoom employees.
The Utsunomiya District Court conducted preparatory proceedings for a lawsuit filed by the Utsunomiya Gyoza Association, which demanded that Miki Co., Ltd. stop using the trademark and pay damages of 2.2 million yen, alleging that it was illegally using the registered trademark “Utsunomiya Gyoza,” and a settlement was reached.
