飲食店、特に人気店が抱えるリスクのひとつに「模倣」がある。売上に好影響をもたらすと思われる外装や看板、メニューなどが“真似”されるケースは後を絶たない。飲食店にとっては店のすべてが戦略になるため、安易に真似され、地道に築き上げてきた信用やブランドを傷つけられることの影響は小さくない。

［コメント］店舗の内外装の模倣防止に意匠権を活用させるように特許庁や有識者は考えているようですが、特許・意匠登録系の工業所有権は権利が失効したら自由に真似できるというのが原則です。言い換えると、店舗デザインを意匠権で保護するということは、意匠権が切れた日から真似し放題となっていまうということです。この混乱を防ぐ１つの方法としては、店舗の意匠権が存在している間に商標登録もすることになると思います。要件が新規性・創作非容易性から自他商品役務の識別性に上がるところとなりますが、可能性はあるところと思います。
